Litigation

"Litigation" is the term used to describe the adversarial process when one party formally files a lawsuit against another.  The person filing the lawsuit is called the Plaintiff and the person against whom the case is filed is called the Defendant.  Most litigation is settled prior to the case ever going to a trial before a judge or jury.

Litigation is a highly specialized area of law subject to many rules established by the Courts and many unwritten rules practiced by lawyers, judges and other people familiar with the process.  Litigation is a very expensive and emotional process, which often does not result in a "just" outcome for either side.  It is the position of this firm that litigation should be used as a last resort.  

Given the sheer number of lawyers to choose from, selecting an attorney to represent you through the litigation process is an important decision.   The experience and reputation of your attorney will play an important role in the outcome of the case.
